Legal Basis: Vaud notaries are subject to the Federal Act of September 25, 2020, on Data Protection (FADP), the Ordinance of August 31, 2022, on Data Protection (OPDo), as well as the Vaud Act of September 11, 2007, on Personal Data Protection (LPrD/VD). The relationship between notaries and their clients is also covered by professional secrecy (Art. 321 SCC, Art. 42 LNo/VD).

Data Collected: We collect the usual contact and identification data necessary for drafting authentic instruments (identity, postal address, email address, telephone number, date of birth, copy of identity card, marital status) for our client file. Depending on the mandate and the documents to be drawn up, we may require additional data (e.g. AHV number, bank details). All data is generally collected directly from you, so you will always know what data we hold; if data concerning you should exceptionally be collected from third parties, we will inform you without delay.

Legal Basis and Purposes of Processing: the processing of your data is based on your consent (Art. 31 para. 1 FADP), the performance and follow-up of the contract binding us to you (Art. 31 para. 2 lit. a FADP), and/or the fulfillment of a public task (Art. 5 para. 1 lit. b LPrD/VD). Your data will not be processed for any purposes other than those arising from the mandate you have given us.

Retention Period: After the end of the mandate, your file is archived and generally retained for a period of 10 years. The firm reserves the right to retain data for longer periods, in particular those relating to testamentary dispositions or litigation. At the end of the retention period, the firm has the right to destroy any file in its possession. This destruction relieves Etude of all responsibility.

Data Disclosure: We never disclose your data to third parties, except when necessary for the execution of the mandate (e.g., filing an instrument with an authority) and after having informed you. In addition, our technical subcontractors (IT service providers, etc.) are all based in Switzerland or in a country with legislation ensuring an adequate level of protection according to the Federal Council (Germany). Subcontracting is carried out under our responsibility and in compliance with the purposes listed above.
